Madfun Terms and Conditions of Use

1. Introduction

Welcome to the Madfun Events/Travel website (hereinafter, “Madfun”). These Terms and Conditions of Use (“Terms”) apply to your access and use of our website at madfun.com, managed by Palladium Innovations Limited, a Kenyan company registered under Kenyan law with offices at Kalson Towers, 4th Floor, Crescent Lane, Off Parklands Road. By accessing or using our website, you agree to be bound by these Terms, including our Privacy Policy. Please read them carefully.

2. Acceptance of Terms

By accessing or using the Madfun website, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy, available on our website. If you do not agree with any part of these Terms, please refrain from using our website.

3. Communications

By accessing Madfun’s website, you consent to receive communications from us, including newsletters, marketing materials, promotional messages, and other related information. You may opt out of receiving such communications at any time by following the unsubscribe instructions in our communications or by contacting us at info@madfun.com.

5. Event Listings

Eligibility to List

To list an event on Madfun’s website, you must be a legitimate event organizer with all necessary rights, licenses, permits, and authorizations to host and conduct the event. By listing an event, you confirm your compliance with these requirements.

Event Content

Our website allows users to post, link, store, share, and make available various types of content, including text, graphics, videos, and other media (“Content”). You are solely responsible for ensuring that any Content you post is legal, reliable, accurate, and appropriate. By posting Content, you represent and warrant that you either own the Content or have the necessary rights to use and share it. You grant Madfun a worldwide, royalty-free license to use, modify, publicly display, reproduce, and distribute your Content in connection with our services.

Approval and Removal

Madfun reserves the right to review, approve, reject, or remove any event listing at its sole discretion. We may also suspend or remove any event listing that violates these Terms or is determined to be potentially harmful or inappropriate for our users.

6. Promotions and Discounts

Event organizers may offer promotions, discounts, or special offers on event tickets. All promotions and discounts must comply with Madfun’s promotional guidelines, as well as applicable laws and regulations. Any violation of these guidelines may result in removal of the promotion and possible suspension of the listing.

7. Ticket Purchase

Ticket Availability

All tickets listed for sale on the Madfun website are subject to availability. Ticket quantities may be limited, and Madfun does not guarantee that tickets will remain available for any particular event.

Payment

By purchasing tickets through our website, you agree to provide accurate and complete payment information. Payments are processed through secure gateways, and you may be required to provide valid payment details. Madfun reserves the right to refuse or cancel any ticket order for reasons including ticket availability, pricing errors, or suspected fraudulent activity.

Ticket Delivery

Upon successful purchase, tickets will be delivered electronically via email or SMS. You are responsible for ensuring that the provided contact information is accurate and accessible.

Refunds and Cancellation

If an event is canceled, Madfun will issue refunds to ticket purchasers, subject to a modest fee. Refunds will be processed through the original payment method.

In the event of a cancelled or postponed event, customers may request a refund within 7 business days from the official notification of the cancellation or postponement. All refund requests must be submitted within this 7-business day period. After this period, refund requests will no longer be considered valid or processed.

8. Event Postponement and Cancellation Refund Policy

This policy governs ticket refunds for events organized in collaboration with Madfun Events. By purchasing a ticket, the buyer acknowledges and agrees to these terms and conditions. These terms are legally binding and constitute the entire agreement between the ticket holder and Madfun Events.

8.1. Event Postponement

  • In the event of a postponement, all purchased tickets will remain valid for the rescheduled event.
  • Refunds for postponed events may only be requested within seven (7) working days from the date of the official postponement announcement. Any requests made beyond this period will be automatically deemed invalid, and Madfun Events shall have no obligation to process or honor such claims.
  • Refunds for postponed events are subject to:
    • Consultation and approval by the event organizer and Madfun Events.
    • A deduction of applicable transaction fees.
  • Refunds may take up to 30 working days, depending on the mode of payment and advice from the event organizer. Madfun Events shall not be liable for delays caused by third-party payment processors.
  • Madfun Events shall make reasonable efforts to communicate postponements through:
    • Direct communication channels, such as the email address and mobile number provided during ticket purchase, using SMS or chat applications.
    • Official announcements on Madfun Events' social media platforms.
  • Madfun Events shall not be held liable for any indirect, incidental, or consequential losses resulting from the postponement of an event, including but not limited to travel expenses, accommodation, or other associated costs.

8.2. Event Cancellation

  • In the event of a cancellation, refunds will only be processed upon consultation with the event organizer.
  • If the event organizer has utilized the ticket funds for event preparations, Madfun Events will await the organizer to refund the ticketing account. Ticket holders will then be notified of the refund timeline, subject to the organizer’s ability to replenish the refund accounts.
  • Refunds will strictly be issued:
    • To the original payment method used for the ticket purchase.
    • For group tickets, refunds will only be made to the purchaser's original payment method, whether a card or mobile money number.
  • Madfun Events shall make reasonable efforts to communicate cancellations through:
    • Direct communication channels, such as the email address and mobile number provided during ticket purchase, using SMS or chat applications.
    • Official announcements on Madfun Events' social media platforms.
  • Refund requests must be submitted within seven (7) working days of the official cancellation announcement. Requests beyond this period will not be processed, and Madfun Events shall have no liability or obligation to process such claims.
  • Madfun Events shall not be held liable for any delays, disputes, or failures in refunds resulting from the organizer's inability to provide refund funds within the expected timeframe.

8.3. General Terms

  • Force Majeure: Madfun Events shall not be held liable for any refunds, claims, or losses arising from event cancellations or postponements caused by circumstances beyond its control, including but not limited to natural disasters, government-imposed restrictions, public health emergencies, acts of terrorism, or other unforeseen events.
  • Transaction Fees: All refunds are subject to applicable transaction fees, which will be deducted from the refund amount. The ticket holder expressly waives any right to dispute these deductions.
  • Refund Timelines: Refunds may take up to 30 working days, depending on the mode of payment and external banking or mobile money processes. Madfun Events shall not be liable for delays caused by third-party payment processors or financial institutions.
  • Non-Transferability of Tickets: Refunds will only be issued to the original payment method used at the time of purchase. Tickets purchased through resale or transfer are not eligible for refunds unless explicitly authorized by Madfun Events and the event organizer.
  • Ticket Holder Obligations: It is the sole responsibility of the ticket holder to provide accurate contact information at the time of purchase. Madfun Events shall not be liable for any failure to communicate postponement or cancellation notices due to incorrect or outdated contact details provided by the ticket holder.
  • Jurisdiction and Governing Law: This policy shall be governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes arising from this policy shall be subject to the exclusive jurisdiction of the courts of Kenya.

8.4. Communication and Notification

  • Madfun Events will endeavor to communicate any postponement or cancellation of events through:
    • Email notifications to the address provided during ticket purchase.
    • SMS or chat applications using the mobile number provided during ticket purchase.
    • Official announcements on Madfun Events' social media platforms.
  • The ticket holder waives any claims against Madfun Events for failure to receive such communications due to reasons beyond Madfun Events' control, including but not limited to incorrect contact information, network issues, or email spam filters.

By purchasing a ticket, the ticket holder acknowledges and agrees to these terms in full. The ticket holder further waives any rights to initiate claims, lawsuits, or legal action against Madfun Events arising from the postponement or cancellation of an event, except as explicitly provided for under this policy.

9. Contests, Sweepstakes, and Promotions

From time to time, Madfun may offer promotions, contests, or sweepstakes. Participation is subject to separate terms and conditions provided for each specific promotion.

10. User Conduct

Users of our website are expected to adhere to respectful and lawful conduct. Prohibited activities include:

  • Posting or transmitting defamatory, offensive, or harmful content.
  • Engaging in fraudulent or deceptive behavior.
  • Violating intellectual property rights of Madfun or third parties.
  • Attempting unauthorized access to restricted sections of the website.

Violation of these rules may result in termination of your access.

11. Intellectual Property

All content, design, text, graphics, logos, trademarks, images, and software on the Madfun website are the exclusive property of Palladium Innovations Limited or its licensors. Unauthorized reproduction, distribution, or modification is strictly prohibited.

12. Privacy and Data Protection

Madfun is committed to protecting your privacy and complies with Kenya’s Data Protection Act and other relevant regulations. By using our website, you consent to our collection and use of your data as described in our Privacy Policy.
